1. About PassOn

PassOn is a peer-to-peer marketplace and optional gear relay service operated from Bali, Indonesia. It helps people estimate prices, publish listings, discover gear, chat, make swap offers, participate in supported auctions, and arrange handoffs.

PassOn provides technology and coordination tools. Unless expressly stated otherwise, we do not own listed items, take custody of them, act as buyer or seller, guarantee users or listings, or process payment for an item.

2. Acceptance of Terms

By accessing or using getpasson.app, app.getpasson.app, the pricing tool, marketplace, chat, swaps, auctions, or related relay services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use PassOn.

3. Eligibility and Accounts

You must be at least 18 years old and legally able to enter a transaction.
You must provide accurate account information and keep access to your email secure.
You are responsible for activity performed through your authenticated session.
You may not impersonate someone, automate abuse, or create accounts to evade a restriction.

4. How PassOn Works

You may use Snap & Price to receive an AI-assisted market estimate.
An authenticated user can create a listing with item details, asking price, area, condition, and photos.
Users can browse, save, chat, report content, make swap offers, or use available auction features.
Buyer and seller agree on the item, price or swap terms, and a safe handoff location.
After a completed deal, eligible participants may leave a rating.

5. User Responsibilities

Sellers agree to:

List only items they own or are authorized to transfer.
Provide accurate descriptions, photos, condition, defects, included accessories, and pricing.
Keep required ownership and vehicle documentation, including STNK and BPKB where applicable.
Update or remove unavailable items and honor confirmed handoff arrangements.

Buyers agree to:

Review listing details, ask questions, and inspect the item before paying or swapping.
Make genuine offers and honor confirmed handoff arrangements.
Not harass, spam, threaten, manipulate reviews, or attempt unauthorized account access.

6. Fees

Public price checks and the standard self-service marketplace are currently available without an upfront PassOn fee. If PassOn offers a paid managed-relay, promotion, or premium service, the fee and payment method will be disclosed before you accept it. PassOn may introduce or change fees prospectively with clear notice.

Payments for listed items are settled directly between buyer and seller unless a specific PassOn payment product expressly states otherwise.

7. Prohibited Items

Users may not list or request:

Stolen goods, counterfeit goods, or items they are not authorized to transfer.
Weapons, illegal goods, drugs, controlled substances, or regulated items sold without required authorization.
Motor vehicles without legally required ownership documentation.
Animals, hazardous materials, recalled goods, or content that facilitates unlawful activity.

8. Transactions, Handoffs and Payment

Item payments are made directly between buyer and seller. PassOn does not hold or escrow payment for listed items.

Meet at a busy public location and tell someone where you are going.
Inspect and test the item, documentation, serial numbers, and accessories before paying.
Do not send deposits or advance payments unless you independently accept the risk.
PassOn is not a party to the transaction and does not guarantee an item, user, payment, or outcome.

9. AI Pricing and Image Checks

AI outputs are estimates and assistance tools, not professional valuations, authenticity checks, safety certifications, or guarantees. Results can be incomplete, outdated, ungrounded, or incorrect. Market estimates may use available market signals, user-provided information, internal reference data, or a deterministic fallback when live search is unavailable.

Users remain responsible for setting prices, verifying identity and ownership, inspecting items, and deciding whether to transact.

10. Chat, Swaps, Auctions and Reviews

Chat and swap offers must relate to genuine marketplace activity and may not be used for harassment, spam, fraud, or unlawful contact sharing.
A pending swap offer can be accepted or declined only by the intended recipient. Users must verify final swap terms themselves.
Auction availability, timing, reserve rules, and winner selection are shown in the relevant interface. Technical errors may require an auction to be paused, cancelled, or corrected.
Reviews must reflect a genuine completed interaction. PassOn may remove fraudulent, retaliatory, abusive, or unrelated ratings.

11. Moderation and Account Restrictions

PassOn may investigate reports and remove content, restrict functionality, suspend accounts, or permanently ban users when reasonably necessary for safety, fraud prevention, legal compliance, platform integrity, or repeated violations. Relevant records may be preserved when required to investigate abuse or comply with law.

12. Gear Passport

Gear Passport origin and other provenance information are user-provided unless expressly identified otherwise. They are not proof of ownership, authenticity, import status, or transaction history.

13. User Content and Intellectual Property

PassOn branding, logos, and original content belong to PassOn. Users may not reproduce them without permission.

You retain ownership of content you submit. You grant PassOn a worldwide, non-exclusive, royalty-free license to host, process, reproduce, format, display, and distribute that content only as needed to operate, secure, promote, and improve the marketplace and related relay channels. You confirm that you have the rights needed to submit it.

14. Availability and Changes

PassOn may change, suspend, or discontinue features; correct errors; perform maintenance; or limit access. We do not guarantee uninterrupted availability, permanent storage of drafts, successful notification delivery, or that every listing will remain available.

15. Disclaimers and Limitation of Liability

To the extent permitted by applicable law, PassOn is provided “as is” and “as available.” PassOn is not responsible for user conduct; item quality, safety, legality, ownership, or condition; disputes; missed handoffs; loss, damage, or theft; AI errors; or indirect or consequential loss arising from a user-to-user transaction.

Nothing in these Terms excludes liability that cannot legally be excluded under Indonesian law.

16. Privacy

Our collection and use of personal information are described in the Privacy Policy.

17. Changes to These Terms

We may update these Terms. We will change the “Last updated” date and provide additional notice when a material change reasonably requires it. Continued use after the effective date means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved under Indonesian jurisdiction.
